New FCFCOA Initiatives Put Children at the Centre of Family Law

The Federal Circuit and Family Court of Australia (Divisions 1 & 2) has launched two groundbreaking initiatives: the Children’s Charter and Kids’ Corner.

During separation, children often feel confused and unheard. These resources are designed to support children whose parents are separating and involved in family law proceedings.

The Children’s Charter commits the Courts to uphold their rights and wellbeing, while Kids’ Corner equips them with clarity and understanding. These initiatives are practical steps toward ensuring children feel seen, heard, and supported throughout the court journey.

What’s New?

Children’s Charter

This Charter outlines the Courts’ pledge to make children the focal point of all decision-making. Based on ten foundational principles, it emphasises the importance of children’s safety, dignity, and active participation, aligning with the UN Convention on the Rights of the Child.

Kids’ Corner

An interactive space on the FCFCOA website, Kids’ Corner offers:

  • Two concise, engaging animations (“What happens when a family goes to Court?” and “What is a Family Expert?”)
  • Clear, age‑appropriate answers to questions about court and family law processes
These resources are tailored to help children better understand what is happening around them.

Below are selected excerpts of endorsements shared during the launch of these new initiatives

Hon Justice Alice Carter (Division 1 & Chair, Courts’ Children’s Committee):
“Article42 of the UN Convention on the Rights of the Child states that Everyone should know about childrens rights. The FCFCOA is committed to honouring those rights through the Childrens Charter, our child participation framework, and initiatives like Kids Corner.

Anne Hollonds, National Children’s Commissioner:
“Providing information about the process is critical to ensuring the safety, rights and wellbeing of children … Children have said that in the past they were ‘kept in the dark’ … I commend the Courts’ leadership to ensure … their views must be listened to and respectfully considered.”

Hon Judge Kylie Beckhouse (Division2):
Today marks an important milestone in our Courts ongoing commitment to children and young people. We have spent considerable time consulting with experts, listening to childrens voices, to ensure that the Charter and other resources are both informative and empowering.

Janet Carmichael, Executive Director—Court Children’s Services:
“The development of Kids’ Corner … was informed by extensive consultation with experts in children, and most importantly, children themselves. This resource reflects our commitment to making the family law system more child‑friendly …”

We invite you to explore the new resources available on the FCFCOA website. The resources provide developmentally appropriate, accessible information and referral options for children involved in family law proceedings.

You will also find practical tools to help explain court processes to children in a clear and supportive way.
